Terms and Conditions.

  1. By accepting a quotation, the client agrees to being invoiced for part payments during the design and building of their web site.
  2. Invoices will be pro rata to the number of pages published to the web.
  3. Payment to be received within 30 days from date of invoice.

Copyright.

  1. All web pages designed and produced by ijb Web Builder are at the invitation of the client.
  2. If web pages produced by ijb Web Builder include items to which the client own the copyright i.e. logo, trademark, name etc. then the client retains the copyright to that item only, not the web page.
  3. However if in the course of designing a web page, ijb Web Builder produce a different version of the copyrighted item, i.e. a graphic design suitable for publishing to the web as part of the web page design, then the intellectual property rights to the version produced by ijb Web Builder belong to ijb Web Builder.
  4. Should the client wish to use this ijb Web Builder designed version of their copyrighted item, then the client should seek permission from ijbWebBuilder before using the design.
  5. By inviting ijbWebBuilder to design web pages, the client accepts that ijb Web Builder are entitled to payment for their design services relating to the clients copyrighted items.
  6. Should the client wish to use ijb Web Builder designed versions of the clients copyrighted items i.e. logo, trademark, name etc. in applications other than the intended ijb Web Builder web page, then the client accepts that ijb Web Builder are entitled to payment for the design of their copyrighted item.
  7. Copyright of web pages designed by ijb Web Builder to remain with ijb Web Builder.

Proposals for web site designs.

  1. Proposals for web sites submitted to the client for evaluation in the form of a CD Rom, usb flash drive etc. are the property of ijbWebBuilder and should be returned to ijbWebBuilder if the client chooses not to use the web design services of ijb Web Builder.
  2. If ijb Web Builder publish web site proposals to the client’s web server for evaluation on line, then ijb Web Builder reserve the right to remove the published web pages should the client choose not to use the web design services of ijb Web Builder.

Domain Name Registration and Web Site Hosting.

  1. Unless specifically stated in our quotation, Domain Name Registration and Web Site Hosting costs are not included in our prices and will be extra to the prices quoted.
  2. ijb Web Builder does not guarantee that the operation of the ISP  Hosting Services or web site design will be uninterrupted, error-free or secure. ijb Web Builder’s sole liability for any break in service shall be to re-design the affected web pages. In the event that ijb Web Builder determines that a re-design is not commercially feasible, ijb Web Builder may terminate this Agreement and will receive payment for the work to date on a pro-rata basis. What is or is not commercially feasible shall be in the sole discretion of ijb Web Builder.
  3. In no event will ijb Web Builder be liable for any claim or demands or damages, including without limitation, direct indirect, incidental, special, consequential, or punitive damages arising out of the use or inability to use the Services or any content thereof for any reason. This disclaimer applies, without limitation, to any damages or injury, whether for any breach of contract, tort or otherwise caused; any failure of performance; error; omission; interruption; deletion; defect; delay in operation or transmissions; computer virus; file corruption; communication line failure; network or system outage; or theft, destruction, unauthorised access to, alteration of, or use of any record. In no event will ijb Web Builder’s liability under these Conditions exceed the Charges for the Services.
  4. ijb Web Builder will not be held responsible for any inaccuracies or errors in published web pages, it is the responsibility of the client to check that the content of web pages is correct and what is required.
  5. ijb Web Builder will not be held responsible for any delays or problems arising from the web site being un obtainable due to the ISP hosting provider/services  for any reason whatsoever. Any problems with the site must be reported as soon as possible and will be rectified as soon as practical. No responsibility will be accepted as to any losses or problems arising from the site for any reason unless specifically agreed beforehand.
  6. If payment is not received by ijb Web Builder for hosting by the due date on the invoice ijb Web Builder reserves the right to terminate the hosting.

Domain name reservation

  1. Domain names are registered with the most suitable provider at the time. ijb Web Builder reserve the right to register and host with the most suitable company. ijb Web Builder assumed no responsibility whatsoever for any problems arising from these choices, and the site owner must abide by any such terms put forward by the host.
  2. All domain names remain the property of ijb Web Builder until the balance on the customers account has been cleared in full.

Website design

  1. If after beginning work on an agreed quotation, the clients requirements change, then these will be deemed new instructions and quoted for accordingly.
  2. ijb Web Builder reserve the right to promote web sites developed by ijb Web Builder as part of their portfolio and their promotional activities.

Customer warranty

  1. The Customer shall indemnify, defend save and hold ijb Web Builder harmless from any and all liabilities, including legal fees and costs arising out of third party claims against ijb Web Builder arising from or in any manner connected with the Customer’s use or misuse of the Services in any manner not specifically authorised by ijb Web Builder.

Termination provisions

  1. ijb Web Builder reserves the right to suspend or terminate all or part of their Services with immediate effect and without notice, where there has been a breach by the Customer of these terms and conditions or failure to pay Charges outstanding. Either Party may terminate the Services with or without cause on giving 30 days written notice to the other. Termination of this agreement will be without prejudice to any accrued rights of either party.
  2. ijb Web Builder reserves the right to alter these terms without notice.
